Whattodoinpuglia.com is an online platform that lets Hosts create Listings to offer Tours. They e-mail us their listing, prices, etc, which we then place online. Tours involve local activities in categories such as outdoors (i.e., hiking, biking, sailing, etc.), food & drinks (i.e., foodie dinner party at favorite local restaurant, wine tours, catered/take out lunches, etc.), wellness (i.e., yoga, meditation, etc.), sightseeing, and other local activities offered by Hosts. Guests can book an Tour offered by Hosts.
“Tour” means a qualified local visit, creative, outdoor, meal, wellness, or other local activity offered by a Host, either as a single Tour (which takes place on a single day) or as an Immersive Tour (which takes place over multiple days).
“Guest” means a person who books an Tour via our website
“Host” means an organization that gave us permission to make their Tour available for booking on our website.
“Listing” means an Tour that is created, submitted, listed or otherwise made available by a Host for booking via our website.
“Services” means an online platform that allows parties to connect, via the whattodoinpuglia.com website, Guests seeking an Tour can book an activity or tour; and Hosts seeking to post a Listing on our website can connect with independent third party service providers who wish to provide services to Hosts .
Relationship of the Parties
If you create a Listing on Whattodoinpuglia.com and/or Host an Tour, you understand and agree that your relationship with whattodoinpuglia.com is limited to being a partner and an independent, third-party contractor, and not an employee, agent, joint venturer, commercial joint-venturer of whattodoinpuglia.com for any reason, and you act exclusively on your own behalf and for your own benefit, and not on behalf of or for the benefit of whattodoinpuglia.com. whattodoinpuglia.com shall not control, and has no right to control, your Listing or Tour, or any details in connection with any Listing or Tour. You acknowledge and agree that you alone are responsible for any Listing you submit, for your Tour, and for any offline activities associated with your Tour.
When Guests and Hosts make, receive, or accept a booking through the Services, they are entering into a contract directly with each other.
Hosts alone are responsible for the Tours they submit and provide. whattodoinpuglia.com merely provides a platform and is not itself an operator or provider of tours, activities, travel services, or Tours. whattodoinpuglia.com does not own, sell, resell, furnish, provide, manage and/or control any such Tours. whattodoinpuglia.com’s responsibilities are limited to making the services available through its website.
While we think Guests and Hosts will enjoy the Tour(s) provided by Hosts, we do not endorse any Guest, Host, Listing or Tour. We can’t guarantee or control the accuracy, completeness, quality, safety, suitability, satisfaction or usefulness of any Tour or Listing, nor the conduct of any Host or Guest or other users of the Services. The decision whether to list, book, host or participate in an Tour is yours alone, and you do so at your sole risk.
You must comply with your local laws
Whether you are a host or a guest, you alone are responsible for identifying, understanding and complying with all laws that apply to your tour. If you’re an tour host, please make sure you read, understand and comply with all the laws that apply to your tour, including but not limited to any taxes (such as income, sales and use, food services or other local taxes) that you may have to pay on your earnings or any tourism, tour guide or package travel, licensing laws or other laws governing events, activities, and tours of public spaces and other venues. For example, in many cities, hosts may have to register, get a permit, or obtain a license before preparing food or serving alcohol for sale. Some cities may require a license to guide tours or to sail. Hosts alone are responsible for identifying and obtaining any required licenses, permits, or registrations for any tour they offer.
If you’re an tour guest, certain laws, like the minimum legal drinking age of your destination city, may also apply to your participation in an tour or parts of an tour. Your host may also require you to sign a liability waiver if you choose to participate in certain activities, like hiking, biking, or skydiving.
By hosting, booking or participating in an tour, you represent and warrant to us that you understand and comply with all laws that apply to your tour. If you are a guest and book an tour on behalf of yourself plus additional guests, you represent and warrant that your additional guests (i.e., the people on whose behalf you book and whom you bring to the tour ) also reviewed and agreed to these terms before they participate in the tour. You also represent and warrant that you will only bring people along to an tour if those individuals are included and accounted for in your booking.
When Guests and Hosts make, receive or accept a booking through the Services, we are only there to take the deposit, which is our commission. For the rest, they are contracting only with each other.
Hosts understand and agree that they are responsible for determining any applicable tax reporting requirements and agree to pay any taxes applicable to their Tour.
“Tour Fees” are the fees payable by a Guest for participation in the Tour. The Host and whattodoinpuglia.com are together responsible for setting his or her Tour Fees. Guests will see and have to agree to applicable Tour Fees before booking an Tour.
To help our Members have good Tour(s), Hosts and Guests agree to the following terms of conduct, in addition to those contained in the TOS :
- Guests and Hosts will not bring additional guests to an Tour unless such a Guest booked an Tour through (or was added as an additional Guest for a spot booked through) the Services.
- Hosts will fully educate and inform Guests about anything they may need to know to safely participate in their Tour (including fitness requirements, dress codes, equipment they may need, water bottles, physical challenges, etc.).
- Guests will fully inform Hosts of any allergies, medical or physical conditions, or other circumstances that may impact their ability to safely participate in an Tour.
- Hosts and Guests will comply with all applicable local, state, provincial, national, or other laws or regulations, or any order of a court.
- Hosts and Guests will not violate or infringe anyone else’s rights or otherwise cause harm to anyone.
- Hosts and Guests will not breach any agreement you may have with any third party.
If, in our sole discretion, we think that (a) you’re using the platform in a way that is inappropriate, offensive, fraudulent, or unsafe; (b) you have provided inaccurate, fraudulent, outdated or incomplete information during the identity verification, booking or listing process or thereafter; (c) you have violated applicable laws, regulations, or third party rights; or (d) you have violated these TOS, we may suspend your use of whattodoinpuglia.com.
If you choose to use the services, you do so voluntarily and at your own risk. The services are provided “as is,” without warranty of any kind, either express or implied. Without limiting the foregoing, whattodoinpuglia.com explicitly disclaims any warranties of merchantability, safety, satisfactory quality, fitness for a particular purpose, quiet enjoyment or non-infringement, tax-exempt status or tax deductibility, and any warranties arising out of course of dealing or usage or trade, to the fullest extent permitted by applicable law. You agree that you have had whatever opportunity you deem necessary to investigate the tour, laws, rules or regulations that may be applicable to the tour you are offering and/or receiving and that you are not relying upon any statement of law or fact made by whattodoinpuglia.com relating to your tour.
You are solely responsible for all of your communications through, and interactions arranged through, the services. You understand that whattodoinpuglia.com tries to do their best to make the listings as accurate as possible, but we do not make any attempt to verify the statements of users of the services and has no obligation to review any listings, tours, hosts, guests, nonprofits, or third parties with whom you may interact during an tour. whattodoinpuglia.com makes no representations or warranties as to the conduct of members or of quality and safety of whattodoinpuglia.com explicitly disclaims all liability for any act or omission of any guest, host, or related to any tour, listing or booking.
You acknowledge and agree that, to the maximum extent permitted by law, you assume the entire risk arising out of your access to and use of the services, your participation in an tour, and any contact you have with guests, hosts or third parties that arise from your use of the services whether in person or online.
You understand and agree that some tours may carry inherent risk, and by participating in those tours, you choose to assume those risks voluntarily. for example, some tours may carry risk of illness, bodily injury, disability, or death, and you freely and willfully assume those risks by choosing to participate in those tours. You assume full responsibility for the choices you made before, during and after your participation in tours, and to the maximum extent permitted by law you release whattodoinpuglia.com from any and all liability, damages, or loss, whether economic or non-economic, of any type or character. You acknowledge that whattodoinpuglia.com is not responsible for the tours provided by hosts, and that it has no right to and does not control, direct, or supervise hosts, guests or third parties who may be in attendance in the tour. whattodoinpuglia.com does not deliver tours or listings. To the maximum extent permitted by law we will not be liable for any damage arising out of or in connection with tours, listings or your participation in any tour, whether based on warranty, contract, tort (including negligence), product liability or any other legal theory.
If you are bringing a minor as an additional guest, you acknowledge and agree that you are solely responsible for the supervision of that minor throughout the duration of your tour and to the maximum extent permitted by law you agree to release and hold harmless whattodoinpuglia.com from all liabilities and claims that arise in any way from any injury, death, loss or harm that occurs to that minor during the tour or in any way related to your tour.
Limitation of liability
You agree that to the maximum extent permitted by law, the entire risk arising out of your access to and use of the services or tours remains with you.
To the fullest extent permitted by applicable law, whattodoinpuglia.com will not be liable for any incidental, special, exemplary or consequential damages, including lost profits, loss of data or loss of goodwill, service interruption, computer or mobile device damage or system failure or the cost of substitute products or services, or for any damages for personal or bodily injury or emotional distress arising out of or in connection with these terms, from the use of or inability to use the services, your use of the tours or posting of, or request to post, listings, any communications, interactions or meetings with other participants in tours, or other persons with whom you communicate or interact as a result of your use of the services or tours, whether based on warranty, contract, tort (including negligence), product liability or any other legal theory, and whether or not whattodoinpuglia.com has been informed of the possibility of such damage, even if a limited remedy set forth herein is found to have failed of its essential purpose.
